Welcome to Ipaint Gallery. The terms “we,” “us,” and “our” refer to Ipaint Gallery. We operate this website and online store, including its information, content, features, tools, products, and related services, collectively referred to as the “Services.”

Our store is hosted by Shopify, which provides the ecommerce platform that allows us to offer the Services.

These Terms of Service, together with any policies referenced in them, explain your rights and responsibilities when using our Services. They include important provisions concerning warranties, liability, intellectual property, orders, payments, and dispute resolution.

By accessing, browsing, or using the Services, you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not access or use the Services.

Section 1 — Access and Accounts

By using the Services, you confirm that you are at least the age of majority in your state, province, or country of residence. You also confirm that you have authorized any minor dependents under your care to use the Services on devices you own or manage.

When browsing our store, creating an account, or placing an order, you may be asked to provide information such as your email address, billing details, payment information, and shipping address.

We make reasonable efforts to display our products and artwork accurately. However, colors, textures, dimensions, and other visual details may appear differently depending on your screen, device settings, lighting, and display configuration.

Because many artworks include hand-applied brushwork, texture, color layers, and other handmade details, slight variations may occur. These natural variations are part of the artwork’s character and are not considered defects.

We do not guarantee that every product will appear exactly as displayed on your device or that it will meet every subjective expectation.

Product descriptions, prices, availability, and specifications may be updated without prior notice. We reserve the right to discontinue products or limit sales by person, region, or jurisdiction.

Section 3 — Orders

Submitting an order constitutes an offer to purchase. Ipaint Gallery may accept, decline, modify, or cancel an order when reasonably necessary.

An order is accepted only after:

  • Payment has been successfully processed

  • We send an order confirmation

  • The product is confirmed as available

Please review your order carefully before submitting it. Once production or processing begins, we may be unable to change or cancel the order, particularly for customized artwork.

If an order is declined, changed, or canceled, we will attempt to contact you using the email address, billing information, shipping details, or telephone number provided with the order.

Returns and exchanges are governed by our Returns and Refunds Policy.

Unless otherwise agreed in writing, purchases are intended for personal or household use and may not be purchased for unauthorized commercial resale or export.

Section 4 — Prices, Payments, and Billing

Prices, discounts, and promotions may change without notice. The amount charged will be the price shown when the order is placed and confirmed.

Unless otherwise stated, displayed prices may exclude:

  • Sales tax

  • Shipping charges

  • Handling charges

  • Customs duties

  • Import taxes

  • Other destination-specific fees

Prices on our website may differ from prices offered through physical stores, marketplaces, promotional channels, or third-party sellers.

Promotions may be subject to separate terms. If promotional terms conflict with these Terms of Service, the specific promotional terms will apply to that promotion.

You agree to provide accurate and complete payment and account information and to update it when necessary.

By submitting payment information, you confirm that:

  • The information is accurate and complete.

  • You are authorized to use the selected payment method.

  • The payment provider will honor the transaction.

  • You will pay all authorized charges, applicable taxes, and disclosed fees.

Section 5 — Shipping and Delivery

Processing and delivery estimates are provided on our Shipping Policy page. All delivery dates are estimates and are not guaranteed.

Ipaint Gallery is not responsible for delays caused by:

  • Shipping carriers

  • Customs clearance

  • Incorrect shipping details

  • Severe weather

  • Public holidays

  • Remote-area service

  • Events outside our reasonable control

Shipping rights, responsibilities, and risk of loss will be handled according to applicable law and the delivery terms stated in our Shipping Policy.

Section 6 — Intellectual Property

The Services and their content—including trademarks, logos, business names, text, artwork images, product photography, graphics, videos, audio, website layouts, and design elements—are owned by or licensed to Ipaint Gallery and are protected by applicable intellectual property laws.

You may use the Services for personal, lawful, noncommercial purposes only.

Without our prior written permission, you may not:

  • Copy or reproduce our content

  • Modify or create derivative works

  • Republish or publicly display our content

  • Download or store content for commercial use

  • Sell, distribute, license, or transmit our materials

  • Use our artwork images to create or sell reproductions

Nothing in these Terms grants you ownership of or a license to any intellectual property belonging to Ipaint Gallery, Shopify, our artists, licensors, or other third parties.

The Ipaint Gallery name, logo, product names, designs, and slogans may not be used without prior written permission.

Section 7 — Optional Third-Party Tools

We may provide access to tools or services operated by third parties. We do not necessarily monitor, control, or endorse these tools.

Third-party tools are provided on an “as available” basis. Your use of them is at your own discretion and may be subject to the provider’s separate terms and privacy policies.

We are not responsible for losses or damages resulting from your use of optional third-party tools, except where liability cannot legally be excluded.

Future features, tools, and resources added to the Services will also be governed by these Terms.

Section 8 — Third-Party Links

The Services may contain links, embedded content, or functionality provided by third parties.

We do not control and are not responsible for the accuracy, availability, security, products, services, or policies of third-party websites.

If you access a third-party website or purchase products or services from a third party, you do so subject to that party’s terms and policies. Questions or disputes involving third-party products or services should be directed to the relevant provider.

Section 9 — Relationship with Shopify

Ipaint Gallery uses Shopify to operate its online store and provide the Services.

Purchases made through our store are transactions directly between you and Ipaint Gallery. Shopify is not the seller of our artwork and is not responsible for the products, fulfillment, delivery, or customer service provided by Ipaint Gallery.

To the extent permitted by applicable law, you release Shopify and its affiliates from claims arising directly from your purchase transaction with Ipaint Gallery.

Section 10 — Privacy

Personal information collected through the Services is handled in accordance with our Privacy Policy. Certain information may also be processed under Shopify’s Privacy Policy.

Because Shopify hosts our store, Shopify may collect and process information relating to your access to and use of the Services. Information may also be shared with payment providers, shipping partners, technology providers, and other service providers, including providers located outside your country.

Section 11 — Feedback and Reviews

If you submit reviews, ideas, suggestions, photographs, comments, proposals, or other content, collectively referred to as “Feedback,” you grant Ipaint Gallery a worldwide, nonexclusive, royalty-free, transferable, and sublicensable license to use, reproduce, modify, publish, distribute, and display that Feedback for lawful business purposes.

You confirm that:

  • You own the Feedback or have permission to submit it.

  • The Feedback is accurate and lawful.

  • You have disclosed any compensation or incentive connected to it.

  • The Feedback does not violate another person’s rights.

We are not required to keep Feedback confidential, pay compensation for it, or respond to it.

We may monitor, edit, reject, or remove Feedback that is unlawful, misleading, abusive, obscene, defamatory, infringing, or otherwise violates these Terms.

You may not submit malicious software, use a false identity, misrepresent the source of Feedback, or post content that violates intellectual property, privacy, publicity, or other legal rights.

Section 12 — Errors, Inaccuracies, and Omissions

The Services may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, prices, promotions, shipping charges, delivery estimates, or availability.

We may correct inaccurate information, update content, or cancel affected orders when reasonably necessary, including after an order has been submitted.

If a canceled order has already been paid, we will provide the appropriate refund.

Section 13 — Prohibited Uses

You may use the Services only for lawful purposes.

You may not use the Services to:

  • Violate any applicable law or regulation

  • Infringe intellectual property or other legal rights

  • Harass, threaten, abuse, defame, or harm another person

You remain responsible for amounts owed before termination.

Provisions concerning intellectual property, feedback, warranties, liability, indemnification, governing law, and other clauses that should reasonably survive termination will remain effective.

Information provided through the Services is intended for general informational purposes. We do not guarantee that all information will always be complete, current, or error-free.

To the fullest extent permitted by law, we disclaim implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, durability, title, and noninfringement.

We do not guarantee that the Services will always be uninterrupted, timely, secure, or free from technical errors.

Some jurisdictions do not permit certain warranty exclusions, so parts of this section may not apply to you.

Section 16 — Limitation of Liability

To the fullest extent permitted by applicable law, Ipaint Gallery and its affiliates, employees, officers, directors, contractors, agents, licensors, and service providers will not be liable for indirect, incidental, special, punitive, or consequential damages arising from your use of the Services or products.

This may include loss of profits, revenue, savings, data, business opportunity, or replacement costs.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including applicable consumer rights.

To the extent permitted by law, you agree to indemnify and hold harmless Ipaint Gallery, Shopify, and their respective affiliates, officers, directors, employees, contractors, agents, licensors, and service providers from third-party claims, losses, liabilities, and reasonable legal costs resulting from:

  • Your violation of applicable law

  • Your infringement of another party’s rights

  • Your misuse of the Services

We will provide reasonable notice of an eligible claim. You agree to cooperate with the defense and provide relevant information when reasonably requested.

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, it will be enforced to the maximum extent permitted by law.

The unenforceable portion will be treated as removed without affecting the validity of the remaining provisions.

Section 19 — Waiver and Entire Agreement

Our failure to enforce a provision of these Terms does not waive our right to enforce it later.

These Terms, together with our Privacy Policy, Shipping Policy, Returns and Refunds Policy, and other policies published on the website, form the complete agreement governing your use of the Services.

They replace prior communications or agreements relating to the same subject matter.

Section 20 — Assignment

You may not transfer or assign your rights or obligations under these Terms without our prior written consent.

We may transfer or assign our rights and obligations as part of a merger, acquisition, restructuring, sale of assets, or other lawful business transaction.

These Terms and any separate agreements through which we provide the Services will be governed by the laws applicable in the jurisdiction where Ipaint Gallery is registered, subject to any mandatory consumer protections that apply in your place of residence.

Disputes will be submitted to courts with lawful jurisdiction unless applicable law requires another forum.
